that introduced all the major changes to F.S. 790?

Most particularly, the author of the bill that introduced licensing for concealed carry.

Concealed carry has been licensed since at least the early 1900s, possibly even the late 1800s. However licensing was a function of each county. The state assumed the licensing role in 1987 upon enactment of shall-issue, That bill took several years to get passed and was offered by Marion Hammer and the NRA.

Slaves, of course, were never allowed to own guns. The first Florida gun-license law was passed in 1893. It was intended specifically to keep guns out of the hands of free Blacks during the rise of the Jim Crow era of state-sponsored anti-Black terrorism.

Not until nearly a half-century later was a White man charged with unlicensed carry in violation of the law of 1893. His conviction was overturned by the Florida Supreme Court in Watson v. Stone, 4 So. 2nd 703. In his 1941 decision, Florida Supreme Court Justice Rivers H. Buford (1878-1959), ruled that:

“The original Act of 1893 was passed when there was a great influx of Negro laborers into the state... The Act was passed for the purpose of disarming the Negro laborers... The statute was never intended to be applied to the white population, and in practice has never been so applied.”

Again, you will find this FL Supreme Court ruling in Watson v. Stone (1941), 4 So. 2nd 703.

I sort of figured that Ms Hammer was really behind it as when I was talking to a state official about the legislation I got a "she" in a sentence or two and I doubt a female legislator would be an introducer of such a bill.

Let me rephrase. Which legislator (legislator's name) filed the original bill on behalf of the NRA?

Good question. I wasn't here in 1987 so I don't know. Perhaps one of our esteemed members will know.


Senator Richard Langley (SB253 and SB254) and Representative Ron Johnson (HB251 and HB253) sponsored the bills in both the 1986 session (failed in committee) and 1987. The bills they sponsored became the Hagler Act (shall issue CC) and the Carlucci Act (preemption).
